Overview


Edwards Lifesciences Corporation and its subsidiaries and affiliates, (collectively "Edwards Lifesciences") issue this Data Privacy Notice for healthcare service providers to describe how we handle the personal data we hold about you. Edwards Lifesciences respects the privacy rights of individuals and are committed to handling personal data responsibly and in accordance with applicable law. Note that for the purpose of this notice, the data controller in relation to your data will be the Edwards Lifesciences group company in your particular country of residence. 

Types of personal data we collect


In the course of contracting and providing services, we may process personal data about you which include, but are not limited to: 
• Identification data and contact details – such as your name, email address, phone no., country of residence
• Information about your role – such as job title, employer name, academic/professional qualifications.

Sources of personal data


The Personal Data specified above will typically be provided by you through Edwards Lifesciences´ website or similar platform.

Purposes for processing personal data


We collect and process this personal data in order to enable your registration to educational events (such as symposiums, forums, conferences) organized by Edwards Lifesciences.

Who we share your personal data with


Edwards Lifesciences takes care to allow access to personal data only to those who require such access to perform their tasks and duties, and to third parties who have a legitimate purpose for accessing it. Whenever we permit a third party to access personal data, we will implement appropriate measures to ensure the data is used in a manner consistent with this Notice. In particular, we will require those third parties to ensure that the confidentiality and integrity of the information is maintained and require that they have in place and maintain appropriate technical and organizational security measures. 
(i) Transfers to other group companies We may share your personal data with other Edwards Lifesciences companies as necessary for management of the training programs and other legitimate business purposes. 
(ii) Transfers to third party agents and service providers We will transfer your personal data to third parties where legally required to carry out our obligations under the Agreement (for example, to tax authorities if we have made payments directly to you).  In addition, we make certain personal data available to third parties who provide services to us. We do so on a "need to know basis" and in accordance with applicable data privacy law.  For example, if you communicate directly with Edwards through email, we have third parties who provide, support and maintain our IT and communications infrastructure (including for data storage purposes), and/or provide business continuity services, e.g Amazon Web Services. 
(iii) Other transfers to third parties We may also disclose personal data to third parties on other lawful grounds, including
(i) to comply with our legal obligations, including where necessary to abide by law, regulation or contract, or to respond to a court order, administrative or judicial process, or to meet national security or law enforcement requests, including, but not limited to, a subpoena or search warrant.;
(ii) with your consent;
(iii) as necessary to establish, exercise or defend against potential, threatened or actual litigation;
(iv) where necessary to protect your vital interests or those of another person; or
(v) in connection with the sale, assignment or other transfer of all or part of our business.

Transfers of data across borders

   
As Edwards Lifesciences operates at a global level, we may also need to transfer personal data to other countries where we operate. Particularly, your Personal Data may be transferred to the United States, as Edwards Lifesciences is a global group of companies headquartered in Irvine, California in the United States.

Your data privacy rights


Under applicable law, you may have a right
(i) to request access and obtain a copy of your personal data,
(ii) to request updates, rectification or erasure, including if your personal data is inaccurate or no longer necessary in relation to the purposes for which it was collected;
(iii) to restrict the processing of your personal data; and
(iv) if applicable, to request portability of your data. 

In certain circumstances, you may also have the right to object to the processing of your personal data.  Any such request can be made to the Privacy office at [email protected].   If you have concerns that your data are being processed improperly, you have the right to lodge a complaint free of charge with your local data protection authority (DPA). We will cooperate with the relevant DPA in investigations and resolutions of complaints relating to this Notice. We commit to work together and to follow the advice of these authorities in good faith. If we are relying on your consent to process your personal data, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of processing that took place before consent was withdrawn, nor will it affect processing of your personal data conducted in reliance on lawful processing grounds other than consent.

Data retention periods


Your Personal Data will be maintained only for as long as necessary to achieve the purpose defined above or for a period required by relevant laws.

Automated Decision-Making


Edwards Lifesciences does not engage in automated decision-making.
